INTRODUCTION

The Legal Unit is one of the service units directly under the Office of the Executive Secretary. 

It was primarily established to interpret laws and instruments entered into/executed by the Commission and in the event of any litigation represent the Commission in court(s) through external solicitors. 

It is supervised by the Special Adviser to the Executive Secretary.

STRUCTURE

The Unit is headed by the Legal Adviser who is assisted by a team of Legal Officers at the Headquarters and others in different Zonal/State Offices.

FUNCTIONS

The Unit’s roles include:

• Proffering legal advice to the Commission; and in some instances to State Universal Basic Education Boards who require assistance;
• Liaising with appropriate departments and consultant on contract/project matters, drafting and executing legal instruments;
• Liaising with Banks on the confirmation of Contractors Advance Payment Guarantees, Performance Securities etc;
• Alternative Dispute resolution and other controversies without resulting to litigation;
• Liaison between the Commission and Security Agencies e.g. EFCC, ICPC etc;
• Documentation of all contracts entered into by the Commission;
• Attend Court sitting and watch briefs on behalf of the Commission;
• Signs and certifies the States Universal Basic Education Board (SUBEBs) Action Plans; and 
• Performs any other additional duties assigned to it by the Executive Secretary.
